Pre-Employment Background Checks in California:
Dangers and Landmines Facing Private Investigators

To avoid bad hiring decisions, employers have turned to pre-employment background screening as a risk management tool. However, background checks are increasingly subject to litigation, legislation and regulation. In addition, California has its own set of detailed requirements, and any failure to dot just one "i" or cross one "t' can expose a PI to $10,000 civil liability per background check even if no one was actually harmed.  More importantly, there is no exception to federal and state laws for Private Investigators, who are subject to all the same laws and regulations as any other Consumer Reporting Agency.

Lester Rosen is an attorney and licensed Private Investigator in California.  He is the Founder and CEO of Employment Screening Resources (ESR), a nationwide background check firm accredited by the National Association of Professional Background Screeners (NAPBS). He is the author of "The Safe Hiring Manual," the first comprehensive guide to background checks, and "The Safe Hiring Audit." He was the chairperson of the steering committee that founded the NAPBS and served as the first co-chair. He is a nationally recognized expert on background checks who has presented at numerous national and statewide conferences.  He has qualified and testified as an expert witness on background checks.   Mr. Rosen is a former criminal defense trial attorney and former Deputy District Attorney and has been involved in drafting the current California laws governing background checks.
